Without prejudice to any outstanding matters or issues the Authorised Officer DECIDED to grant Mr Lawson Akhigbe a practising certificate for the practice year 2011/2012 subject to the condition that save for the purposes of completing the winding up of his former practice Akhigbe & Akhigbe Solicitors, he may not act as principal of any recognised body.
Reasons/basis
Mr Lawson Akhigbe is subject to Regulation 3.1 of the SRA Practising Regulations 2011, as a consequence of regulatory matters. Accordingly, the Authorised Officer was required to consider whether to impose any practising certificate condition in accordance with Regulation 7 of the SRA Practising Regulations 2011 which sets out the purposes for which conditions may, in the public interest, be imposed on a solicitor's practising certificate. In making this decision, the Authorised Officer had consideration to the regulatory objectives set out in Section 1 and 28 of the Legal Services Act 2007 along with the tests set out in the matters of A Odunlami [2008] EWCA Civ 1598 and F Razeen [2008] EWCA Civ 1220. The Authorised Officer was satisfied that, in the light of Mr Akhigbe's recent regulatory history, the above practising certificate conditions are necessary, reasonable and proportionate in the interests of protection of the public. The Authorised Officer was satisfied, in line with the SRA's publication policy, that it was in the public interest to publish this decision.
