Decision details

To exercise the powers conferred by Section 16(4) of the Solicitors Act 1974 (as amended) and Regulations 5 and 6 of the SRA Practsing Regulations 2009 to terminate the automatic suspension of Mr G J Reilly's practising certificate for the practice year 201/2011subject to the conditions that:
1) he may act as a solicitor only in employment;
2) he may not be a sole practitioner or manager or owner of a recognised body;
3) Mr Reilly shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition;
4) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors' Code of Conduct 2007.

Reasons/basis
Due to Mr Reilly's bankruptcy order and having regard to Regulation 6.1(a) of the SRA Practising Regulations 2009, it is considered that the conditions will limit and restrict his involvement in certain activities undertaken in legal practice which it is not in the public interests of the public that he should undertake as a principal whilst adjudicated bankrupt.The conditions are imposed purely as a regulatory measure and are exclusively as a result of the bankruptcy order.

Decision details
The Authorised Officer has DECIDED to grant Mr Gerard James Reilly a practising certificate for the practice year 2011/2012 free from conditions.
Reasons/basis

Mr Reilly is subject to Regulation 3.1 of the SRA Practising Regulations 2011, as detailed above, as a consequence of financial matters.

Accordingly, the Authorised Officer is required to consider whether to impose any practising certificate condition in accordance with Regulation 7 of the SRA Practising Regulations 2011 which sets out the purposes for which conditions may, in the public interest, be imposed on a solicitor's practising certificate.

The Authorised Officer notes that Mr Reilly was discharged from bankruptcy on 17 May 2012. Having had regard for Mr Reilly's financial and regulatory history, there are no matters of concern that warrant the imposition of conditions on his practising certificate for the practice year 2011/2012.

The Authorised Officer has also had consideration to the regulatory objectives set out in Section 1 and Section 28 of the Legal Services Act 2007 along with the tests set out in the matters of A Odunlami [2008] EWCA Civ 1598 and F Razeen [2008] EWCA Civ 1220.

The Authorised Officer is satisfied that it is not necessary, reasonable or proportionate in the interests of protection of the public to impose any practising certificate condition at this time. The Authorised Officer is also satisfied that none of the purposes specified in Regulation 7 of the SRA Practising Regulations 2011 make it necessary in the interests of the public to impose any practising certificate condition.

Accordingly, the Authorised Officer authorises the issue of an unconditional practising certificate.
