Decision details
Pursuant to Section 16(4) of the Solicitors Act 1974 (as amended) and Regulations 5(a) and 6 of the SRA Practising Regulations 2009, to terminate the automatic suspension of Mr Brian Michael Taylor's current practising certificate for the practice year 2010/2011, subject to the conditions that; (1) he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority; (2) he is not a sole practitioner or a manager or owner of a recognised body; and (3) he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.
Reasons/basis
In light of Mr Brian Michael Taylor being adjudged bankrupt on 27 July 2011 and his pending appearance before the Solicitors Disciplinary Tribunal, the SRA was satisfied that imposing the above condition requiring Mr Taylor to obtain the SRA’s written approval before taking certain steps will, in the public interest, limit, halt or prevent a risk to clients, third parties or the public in accordance with Regulation 6.1(c) of the SRA Practising Regulations 2009. The SRA was satisfied that the above conditions are reasonable, necessary and appropriate in the interests of the public.

The Authorised Officer has had regard to regulation 7.1(a) of the SRA Practising Regulations 2011 and consider Mr Taylor unsuitable to undertake certain activities in relation to a legal practice, either at all or save as specified in the condition, and that imposing the condition will, in the public interest, limit, restrict, halt or prevent the involvement of Mr Taylor in those activities.
