Decision details

The Authorised Officer has DECIDED to grant Philip Aveyard a practising certificate for the practice year 2011/2012 subject to the following conditions:-

1.1 he is not a sole practitioner or sole director of recognised body;

1.2 he is not a manager or owner of a recognised body or licensable body where all the other managers or owners

1.2.1 have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority.

1.2.2 are recognised bodies of which he is a sole director.

1.3 Mr Aveyard shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reasons for their imposition.

Reasons/basis

Mr Aveyard is subject to Regulation 3 of the SRA Practising Regulations 2011, as detailed above, as a consequence of regulatory matters.

Accordingly, the Authorised Officer is required to consider whether to impose any practising certificate condition in accordance with Regulation 7 of the SRA Practising Regulations 2011 which sets out the purposes for which conditions may, in the public interest, be imposed on a solicitor's practising certificate.

The Authorised Officer has had consideration of the findings when Mr Aveyard appeared before the Solicitors Disciplinary Tribunal as well as his significant and continued absence from the profession and is satisfied that the above conditions should remain on Mr Aveyard's practising certificate.

The Authorised Officer has had regard to 7.1(a) of the SRA Practising Regulations and considers Mr Aveyard is unsuitable to undertake certain activities in relation to a legal practice, either at all or save as specified in the condition, and that imposing the condition will, in the public interest, limit, restrict, halt or prevent the involvement of Mr Aveyard in those activities.

The Authorised Officer is satisfied, in line with the SRA's publication policy, that it is in the public interest to publish this decision.
