Decision details

The Authorised Officer has DECIDED to grant Andrew David Somper a practising certificate for the practice year 2011/2012 subject to the following conditions:-

1.1 he is not a sole practitioner or sole director of recognised body;

1.2 he is not a manager or owner of a recognised body or licensable where all the other managers or owners

1.2.1 have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority.

1.2.2 are recognised bodies of which he is a sole director.

1.3 Mr Somper shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reasons for their imposition.

1.4 He attends courses accredited by the Solicitors Regulation Authority on the new SRA Handbook (replacing the Solicitors Code of Conduct) and SRA Accounts Rules 2011 within 6 months of the date of notification of this decision and provides confirmation of the completion of this course (in the form of a certificate or letter of notification from the course provider) when he next applies for a practising certificate.

Reasons/basis

Mr Somper is subject to Regulation 3.1 of the SRA Practising Regulations 2011, as detailed above, as a consequence of regulatory matters.

At present, Mr Somper does not hold an active practising certificate. Mr Somper has made an application for a practising certificate for practise year 2011/2012. Mr Somper has not held a practising certificate since practise year 2001/2002. Mr Somper was restored to the roll as recently as 7 February 2012.

In light of the above, the Authorised Officer considers the above conditions to be necessary reasonable and proportionate.

The Authorised Officer is satisfied, in line with the SRA's publication policy, that it is in the public interest to publish this decision.
