      Reasons/basis


      The Committee was satisfied that grounds for intervention existed under section 9 Paragraphs 32 (1) (a), (c) and (e) of Schedule 2 of the Administration of Justice Act 1985 namely that the recognised body, WB Legal LLP;


      1) has failed to comply with the Solicitors’ Accounts Rules 1998;


      2) went into Administration in March 2009; and


      3) it was necessary to exercise powers to protect the interests of clients or former or potential clients of the recognised body.


      In addition, The Committee was satisfied that grounds for intervention existed under 1(1) (c), and (m) of Part I of Schedule 1 Solicitors Act 1974, namely that Mr Windsor and Mr Gadd had failed to comply with the Solicitors’ Code of Conduct 2007, the Solicitors’ Accounts Rules 1998 and it was necessary to exercise powers to protect the interests of clients or former or potential clients of Mr Windsor and Mr Gadd or their firm.

      SDT case 9848-07. Decision of 29-9-2009. published April 2010 on SRA website SDT findings.

      Having found the First Respondent to have been dishonest in his dealings with clients’ monies and having found all the other outstanding allegations against him to be proved, the Tribunal was satisfied that he was unfit to practise as a solicitor and that it was appropriate both in the interests of the public and of the profession that he be struck off the Roll of Solicitors.
