In all my years’ experience dealing with errant professionals, this is the worst firm I have ever come across.
Our complaint centred on their poor handling of 2 family trusts for which they were trustees. This included unexplained losses on the funds held, excessive fees which tripled overnight without explanation, persuading a beneficiary with mental health issues to approve the appointment of a second partner in their firm to avoid outside scrutiny, a number of errors in dealing with the administration and taxation of the trusts and failing to keep the beneficiaries informed.
Throughout the complaints process they maintained their position that they had no duty of care towards the beneficiaries of the trusts as they were not direct clients of their business refusing to take responsibility for their actions. They did not follow their own complaints procedure and, instead, tried to obscure the issues raised even spurning any request to meet with them to discuss the issues that had arisen or explain their point of view. At one point I even had the phone put down on me for no reason – there was no aggression from our side.
As a result of their refusal to communicate we had to escalate our complaint to the Ombudsman who felt they were unable to help because trust laws are written to protect trustees even when they fail to adhere to proper or accepted standards.
Senior management and the chairman of the business were contacted to ask them to use their integrity to reach a fair and reasonable settlement, but we were summarily dismissed without them even taking the trouble to review the paperwork.
Although the family received a small reduction in the fees charged (just over £7,000), this was nowhere near the money lost to the family (which was more like £50,000) and we remain aggrieved.
