Patrick Julian Smith practised as a partner in the firm Patrick Smith & Co at 18 Newbury Street, Wantage, Oxfordshire until its closure on 27 December 2015.

Mr Smith was found to have:

Acted in breach of Rules 29.1, 29.2 and 29.4 of the SRA Accounts Rules 2011 (the Accounts Rules) by failing to keep the firm's accounting records properly written up and failing to record appropriately all dealings with client money.
Acted in breach of Rule 29.12 of the Accounts Rules by failing to undertake reconciliations on the client accounts within the maximum permitted five week intervals.
Acted in breach of Rule 20.6 of the Accounts Rules and Principles 4 and 10 by withdrawing money in relation to a particular client in excess of the money held for that client and thereby not acting in the best interests of each client and not protecting client money.
Acted in breach of Rules 7.1 and 7.2 of the Accounts Rules by failing to ensure that breaches of the Accounts Rules were remedied promptly.
Acted in breach of Rule 6.1 of the Accounts Rules by failing to ensure compliance with them.
Failed to achieve Outcome 7.2 of the SRA Code of Conduct 2011 by failing to maintain effective systems and controls to ensure compliance with the Principles, Outcomes in the Code and Accounts Rules, as applicable.
Acted in breach of Principle 8 in not managing his business and carrying out his role in the firm effectively and in accordance with proper governance and sound risk management principles.

Mr Smith was given a written rebuke and ordered to pay a financial penalty of ?1,500 and costs of ?675.
