Reasons/basis

The facts:

Mr Liam Gallagher, a person who is not a solicitor, was employed by Leathes Prior Solicitors LLP between 1 November 2013 and 5 August 2014. He worked in the firm's Finance and Facilities department in Norwich. During his employment Mr Gallagher was found to have misappropriated ?10,200.00 of client money for his own use and had sought to cover this up by way of purported letters to clients sending out stamps and postal orders. These funds have been replaced by the firm.

Finding:

It was found that Mr Gallagher acted dishonestly by carrying out the above conduct and that his actions also breached Principles 2, 4, 6 and 10 of the SRA Principles2011 and Rules 14.3, 20.1 and 29.1 of the SRA Accounts Rules 2011.

Mr Gallagher was made subject to an order pursuant to section 43(2) of the Solicitors Act 1974 (as amended) and was given a written rebuke and ordered to pay a financial penalty of ?2,000.00. He was also ordered to pay the SRA's costs of ?600.00 in investigation this matter.

His practising details since leaving Leathes Prior Solicitors on 5 August 2014 are unknown.

Order:

To make a section 43 order that with effect from the date of the letter notifying Mr Gallagher of Norwich, Norfolk of this decision:



(i) no solicitor shall employ or remunerate him in connection with his/her practice as a solicitor;

(ii) no employee of a solicitor shall employ or remunerate him in connection with the solicitor's practice;

(iii) no recognised body shall employ or remunerate him;

(iv) no manager or employee of a recognised body shall employ or remunerate him in connection with the business of that body;

(v) no recognised body or manager or employee of such a body shall permit him to be a manager of the body; and

(vi) no recognised body or manager or employee of such a body shall permit him to have an interest in the body



except in accordance with a Society permission.

This order is subject to an internal right of appeal and a statutory right of review to the Solicitors Disciplinary Tribunal.
