Really impressed with the service! We have used a few solicitors and never used them again due to the service. However, I will be using Mogers Drewett again! Jessica was fantastic with helping us at every turn! She kept us updated and was always chasing everyone to make sure our move went smoothly! I will be recommending them to everyone!!

He was rebuked and directed to pay a penalty of ?2000.

He was ordered to pay ?1350 towards the costs of the investigation of the matters.



Reasons/basis

Richard Pinney was a partner with Mogers Drewett LLP whose head office is at 24 Queen Square, Bath, Somerset, BA1 2HY. He was employed by the firm until December 2015.

Mr Pinney was found to have failed to comply with his legal and regulatory obligations. This included failing to obtain proper identification checks in accordance with the firm's procedures, acting in a situation where a conflict arose and failing to open separate files for clients.

It was found that Mr Peter Pybus:



Failed to obtain identification documents for a client in breach of Principle 8 of the SRA Principles 2011.

Continued to act for a client without providing her with an engagement letter. In doing so he failed to achieve outcomes 1.7 and 1.9 of the SRA Code of Conduct 2011.

Acted where there was a conflict of interest and in doing so failed to achieve outcome 3.5 of the SRA Code of Conduct 2011.

Provided advice to clients in an area of law that he lacked any specialism in. His conduct in this regard failed to achieve outcome 1.4 of the SRA Code of Conduct 2011 and breached SRA Principles 5 and 8.

Provided advice to his clients with an interested third party being present and without an independent qualified interpreter having being present. In doing so he failed to achieve outcome 1.2 and 1.5 of the SRA Code of Conduct 2011 and acted in breach of Principles 4, 5, 6 and 7 of the SRA Principles 2011.

Failed to carry out appropriate identity checks on several clients and in doing so he breached Principle 8 of the SRA Principles.



At the time of the above conduct Mr Pybus was employed by Mogers Drewett LLP as a solicitor in its private client practice group. He left the firm on 30 September 2016. He is not currently practising.

Mr Pybus received a written rebuke and was ordered to pay a financial penalty of ?2,000. He was also ordered to pay the SRA's costs of ?1,350 in investigating this matter.

Ref divorce settlement: I said what I wanted and Mogers did what I wanted. They listened carefully to me as a client – for instance they didn’t try to make the bill expensive by offering me services I didn’t want or need. I was very happy with the service I received from Mogers for my divorce.

I find Mogers great to deal with. They were recommended to me by my tax planners and they operate in a good quality world: those who recommend them and who work alongside them are similarly high quality professionals. I’ve used them for a house purchase, and subsequently for creating a will and they were timely, professional, friendly and reliable. I’d describe them as ‘London brains at West Country prices”!

Just a quick note to say ‘thank you’ for the professional manner that you dealt with my divorce. I really appreciated the e-mail communication, it meant I was fully up to date and things could move quickly.
