04/04/24 - Reviewed by Mortimer Clarke Solicitors - Unethical Practices and Lack of Transparency
I recently had the misfortune of dealing with Mortimer Clarke Solicitors (MC) in relation to a County Court Judgment (CCJ) obtained against me by their client, Cabot Financial (Europe) Ltd. Throughout the process, I found MC's conduct to be unprofessional, unethical, and lacking in transparency.
Despite repeated requests, MC failed to provide crucial documentation, such as a valid Deed of Assignment, which would prove their client's legal right to pursue the debt. This lack of transparency raises serious questions about the legitimacy of the debt and the CCJ.
Furthermore, I discovered that the address used to serve the CCJ was deliberately changed to my old address, even though my current address was known to MC and their client. This underhanded tactic denied me the opportunity to defend myself and resulted in a judgment being entered against me without my knowledge.
When I attempted to raise these concerns with MC, I was met with aggressive, bullying, and threatening behavior. They consistently failed to address the substantive issues and instead resorted to dismissive and evasive tactics.
It is clear that Mortimer Clarke Solicitors has little regard for the rights of individuals and is more concerned with protecting their client's interests, even if it means engaging in unethical and potentially fr__dulent practices.
I strongly advise anyone dealing with Mortimer Clarke Solicitors to be cautious and to thoroughly document all interactions. If you are not satisfied with their conduct or believe that they have acted unethically, do not hesitate to file a complaint with the Solicitors Regulation Authority (SRA).
The SRA has the power to investigate and sanction solicitors who breach their professional obligations. In serious cases, the SRA can impose fines, suspend or even strike off solicitors from the Roll, preventing them from practicing law.
It is crucial that we hold firms like Mortimer Clarke Solicitors accountable for their actions and demand the highest standards of professionalism, integrity, and transparency from those entrusted with upholding the law.
Do not be intimidated by their tactics. Stand up for your rights and take action to ensure that unethical practices are exposed and addressed.

MCS have been chasing me for ancient debts and offering all manner of threats. I assume if they had a case they'd be going to court as they were unable to prove their right to chase the debt when asked... just sent more threatening letters.
As other people have mentioned on this site, there is a special place in HELL reserved for them.
Their employees must've done something wrong in a previous life as by working for MCS they are perpetuating a very evil system - probably why most of the mCS chase mechanism is automated robo-calling...

I recently had a debt that I needed to settle, and unfortunately, my experience with Mortimer Clarke was less than satisfactory. Despite my intentions to settle the debt, I felt that the firm was not interested in finding a mutually beneficial solution. Instead, they seemed more interested in causing maximum damage to my character and credit rating.
From my first interaction with the firm, I was met with a lack of empathy and understanding. The representative I spoke with was short with me and seemed annoyed by my request to settle the debt. I had expected a more professional and courteous approach, but instead, I was met with a cold and uncaring attitude that made me feel like my situation was not taken seriously.
Even when I offered to pay a portion of the debt immediately and to set up a payment plan for the remainder, the firm showed little interest in finding a solution that would work for both parties. They continued to press me for full payment without offering any flexibility, and I felt like they were not willing to listen to my concerns or work with me to find a mutually agreeable solution.
Furthermore, the firm's tactics to collect the debt were ruthless and unnecessary. They threatened me with legal action, and even went as far as sending me a county court claim form. I felt like their goal was not to help me settle the debt, but rather to scare and coerce me into paying as quickly as possible.
Communications addressed to the firm's principal solicitor Sandra Bayne, who has 18 years experience in law, were read but never responded too.
Overall, my experience with this firm was very disappointing. Their lack of empathy and unwillingness to find a mutually beneficial solution left me with a great deal of stress. I would not recommend working with Mortimer Clarke to anyone who values professionalism and understanding when dealing with sensitive financial matters.

I'm on the verge of suicide because of these scammers. After a ccj has been recorded on my file. It's now that I am receiving all their letters warning me that they were going to refer me to the County Court. Which I believe is a tactic to make the situation more difficult for me to handle.

What was this CCJ for. Are you aware that if they bought alleged debt they should produce to you a Deed if Assignment - a legal document -proof of sale? If not they scamming you..they have done to me ..they basing on ppl fear..totally corrupted working all together with Cabot and Wescot.

After getting into some financial difficulties an account I had with a credit card company was passed over to Mortimer Clarke. The staff have been so kind and understanding, made sure I could afford to keep up with the monthly repayments. They would have been happy to take less, with no added interest and whenever I’ve spoken with anyone on the phone I’ve always been reassured that if my financial situation changes they would be happy to help. All I can say is if you’re in trouble, have bailiffs at your door and these guys have your account on their books, give them a call. They WANT to help you.

Had notification bailiffs were going to call. All correspondence was sent to an address I hadn’t lived in for 5.5 years. No attempt seems to have been made to find my current address, and we know they could’ve found it if they wanted to. I could’ve applied to have the CCJ set aside based on correspondence sent to old address but that costs £255. So now I have a CCJ I had no opportunity to respond to so it didn’t get this far.

is that every time they ring me,
I have to repeat myself (it's as though they think,if they ring me continuously, sooner or later,I'll deviate from the truth and tell them what they want to hear,

Found these people to be quite pushy and unprofessional from the outset with threats of legal action vs ticking time clock deadlines to add the pressure.
I am sure they are in breach of code or very borderline and act more like a loan shark collection agency.
If they are collecting debt on behalf of another company then complain directly to that company.

Sent letters claiming I hadn’t payed this debt , when I now for certain that I had . They wanted to argue , wanted me to get proof of payment!
This debt is 15 years old , 2005 it went to court , I received a ccj and payed it off
But according to the law for this type of debt after 6 years the debt is cancelled , a ccj lasts 6 years . If before that time nothing is done they can’t enforce anything. I wonder how many ppl have Allen for this ? Not all debts come under this ruling, also it’s for them to provide proof.
