Mr Ahern may not act as a compliance officer for legal practice (COLP) or compliance officer for finance and administration (COFA) for any authorised body, or Head of Legal Practice (HOLP) or head of finance and administration (HOFA) in any authorised non-SRA firm.
In these conditions the definitions are as defined in the SRA Handbook Glossary 2012.

Mr Ahern's practising certificate for 2016/2017 has been granted subject to the following conditions which are necessary, reasonable and proportionate in the public interest:

Mr Ahern may act as a solicitor only as an employee; whose role has first been approved by the Solicitors Regulation Authority.
Mr Ahern may not act as a manager or owner of any authorised body or authorised non-SRA firm;
Mr Ahern may not act as a compliance office for legal practice (COLP) or compliance officer for financial administration (COFA) for any authorised body or authorised non-SRA firm;
Mr Ahern does not hold, receive or have access to client money, or act as a signatory to any client or office account, or have the power to authorise electronic transfers from any client or office account;
Mr Ahern shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition.

Outcome of SDT Hearing

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the Respondent. The Tribunal had certified that there was a case to answer.

The matter was heard on 17 and 18 October 2017.

Mr Ahern was fined ?15,000.
