25/05/21 - Reviewed by Paul Barrow

I was purchasing a property from Michael Guthrie Developments and ................ was the sellers solicitor.. This development consisted of 6 properties and she previously sold 5 of the properties before my offer was accepted.. These other properties had been occupied for some time (up to 16 months before I viewed..)

I was requested to pay £5000 to reserve the final apartment @ St Aidans house Berwick and my solicitor was instructed to pursue purchase.

It immediately became evident that despite the other 5 properties been sold prior there were defects with the title deeds, lease and there were 3 outstanding planning conditions preventing occupation.. I waited over 6 month's for this firm to resolve the outstanding issues so I could complete the purchase and then days prior to exchange, I was informed the property was going back on the open market because it was considered to be worth more now despite the open reservation agreement in place and the £5000 I had paid.

Following the loss of the purchase, I contacted ........................as I couldn't understand how 5 of the 6 properties could have been sold previously with these defects and outstanding planning conditions preventing occupation.

She informed my solicitor not for me to contact her again , she wouldn't reply to my question's concerning how the other 5 could have been legally sold prior and the reservation agreement I had paid for was not legally binding.

I find this whole situation deplorable and the actions of this solicitor questionable.
