      Divorce

Susan Knight was acting for me in my divorce. In court we came to an agreement of dividing monies and property. I was given 75% of the equity from the sale of our house, valued at £260,000. After subtracting the mortgage, this equated to £145,000.

Her error, which she then lied about, was to write the figure £145,000 instead of putting down the percentage. My solicitor had omitted to apply for a Decree Nisi. Seeing this, my husband dragged out divorce proceedings for another three years as he knew house prices were rapidly rising and I would just get a fixed amount owing to Susan Knights error. In 2003 the house sold for £330,000. Because of her error I ended up with only 50% of the equity. Because I had originally been given a high percentage I had said I wanted no other monies from our endownments etc.

During all this time, Susan Knight told me that the mistake had been made by the court staff who wrote up the orders. I had to plead and plead with her to get her to write to the court staff and the judge to amend the order and change the wording from a fixed amount of money into the percentage which the judge had ordered and we had all agreed upon. She charged me for doing this and allegedly sent many letters to try to fix this mistake.

I eventually became suspicious of her attitude and employed another solicitor. At the final court hearing he and the barrister discovered that the order had been generated from Susan Knights office. I was close to a nervous breakdown by this time. I object to her high charges and the fact that I had to pay for her to lie and pretend to write to the judge and court staff when it had been her mistake all along. I also object to the fact that because of her I received £45,000 less than I should have.

There are a surprising number of incompetent lawyers out there and, more worryingly, several that lack integrity. I too have experienced that - though not to the same cost. Precisely why I am looking to change. Thank you for your comments.
