The reviews here are fake, these guys are not to be trusted cos they will mess you around like nothing, as if you're not paying them. If they treat their paying clients like that then I would hate to imagine how they treat the Legal Aid clients, no thanks!

Decision details



1.1. Duncan Lewis Solicitors Ltd, a recognised body, agrees to the following outcome to the investigation of its conduct by the Solicitors Regulation Authority (SRA):



(a) it is rebuked

(b) it is fined ?1,500

(c) to the publication of this agreement

(d) it will pay the costs of the investigation of ?1,350



Summary of Facts

2.1. On 29 September 2016, the firm identified that 23 cash receipts from clients, received between 10 November 2015 and 23 August 2016 and totalling ?6,117.00, had not been deposited into any of the firm's bank accounts. The firm replaced the money.

2.2. The firm concluded that the money had been misappropriated by an administrative assistant in the firm?s Birmingham office who had responsibility for paying the money into the bank, but had not done so.

2.3. The firm recorded the matter in their breach register but described it in the register and an internal memo as being 'not-material' and as an 'internal issue'.

2.4. The breach was not disclosed to the SRA until 4 January 2017 when a member of the SRA's staff met with the firm about unrelated matters.

Admissions

3.1. Duncan Lewis Solicitors Ltd makes the following admissions which the SRA accepts:



(a) That by failing to notify the SRA promptly of the misappropriation of money by the member of staff it:



i. breached Principle 7 of the SRA Principles 2011 ("the Principles") by failing to comply with its regulatory obligations

ii. failed to achieve Outcome 10.4 of the SRA Code of Conduct 2011 ("the Code") by failing to report to the SRA promptly serious misconduct by an employee.



(b) That it breached Rule 1.2(e) of the SRA Accounts Rules 2011 ("the Accounts Rules") by failing to maintain effective accounting systems, and proper internal controls over those systems. As a result, it failed to discover the misappropriations between 10 November 2015 and 29 September 2016.



Why the agreed outcome is appropriate

4.1. The SRA considers that the agreed outcome is appropriate because the conditions in rule 3.1 of the SRA Disciplinary Rules 2011 are met, in that:



a) the conduct continued for an unreasonable period taking into account its seriousness

b) the conduct was or was related to a failure or refusal to ascertain, recognise or comply with the regulated person's professional or regulatory obligations such as, but not limited to, compliance with requirements imposed by legislation or rules made pursuant to legislation, the SRA, the Law Society, the Legal Ombudsman, the Tribunal or the court

c) the agreed outcome is a proportionate outcome in the public interest

d) the conduct was neither trivial nor justifiably inadvertent.



4.2. In deciding that the agreed outcome is proportionate, the SRA has taken into account the admissions made by Duncan Lewis Solicitors Ltd.

4.3. The amount of the fine takes into account all relevant circumstances, including those set out in Appendix 1 to the SRA Disciplinary Procedure Rules 2011.

4.4. The SRA considers it appropriate that this agreement is published in the interests of transparency in the regulatory and disciplinary process.

Acting in a way which is inconsistent with this Agreement

5.1. Duncan Lewis Solicitors Ltd agrees that it will not act in any way which is inconsistent with this agreement such as, for example, by denying the admissions made in this agreement.

5.2. If Duncan Lewis Solicitors Ltd acts in a way which is inconsistent with this agreement, the conduct which is subject to this agreement may be considered further by the SRA. That may result in a disciplinary outcome or a referral to the Solicitors Disciplinary Tribunal on the original facts and allegations. Acting in a way which is inconsistent with this agreement may also constitute a separate breach of Principles 2, 6 and 7 of the SRA Principles 2011.

Costs

6.1. Duncan Lewis Solicitors Ltd agrees to pay the costs of the SRA's investigation in the sum of ?1,350. Such costs are due within 28 days of a statement of costs due being issued by the SRA.

This solicitors is awful they told me they will call me back in 24h to deal with my case then call me back 2weeks later telling me they can not deal with my case wasting my time and feeding fake info to customers. I believe this solicitors is awful when comes to customer services. I told them my house situation at first and they said yes we are willing to take the case on. Now they are saying that they don't have a solicitor to take on this case I sure will be letting Facebook and the medial know what is going on.

My case was pending with the Home Office after i claimed asylum in 2015. I am disabled and suffer from a number of learning difficulties including William's syndrome. My solicitor Mohammed Nadeem in the Birmingham office not only expedited my asylum interview but managed to pursuade the Home Office to expedite my decision and now i have been granted protection in the UK which means i am safe and can begin my life again. I agree with you Sirwan, Mohammed is not only a fantastic lawyer with a keen eye for detail but his client care skills are brilliant. I instructed Duncan Lewis and Mohammed attended upon me. He noted from my refusal letter, the Home Office applied the wrong Immigration Rule when considering my application. As a result of his appeal, the Home Office withdrew their decision and subsequently granted me leave to remain. Thank you Mohammed, I can now move on with my life.

I do not recommend these people at all, they are willing to take your money and make do with whatever they can. Being a legal aid firm they get paid either way whether they win or lose, never keep you updated, always wanting to get paid, they don't seem to care on what it going on and how. They fobbed me off, took my money and never really gave me an outcome. Could have been better but as they are too lazy to do that, it just shows that they don't really care for their clients.

Very efficient at taking my money but took them nearly 3 months to send me my £230 Home Office refund (and only after I enquired). Their excuse: Busy with Xmas!
Kept telling me I had no right to travel even though I had a valid French ID card...Not very good at listening, often abrupt and patronising. On at least one occasion the quality of the correspondence was poor. It was very obvious the solicitor had signed a letter without reading it. ! Would never use again. One star because they were right for one thing...the Home Office does get it wrong often!

Please be very careful when asking them to take on your case, they are rude, have no empathy, do not stand up for you in court and are terrible at keeping you updated. I agree... recently had a very abrupt ending with the Dalston/Chancery Lane staff. Realised money orientated not client care attitude. Raised my concern fallen on deaf ears - clearly they will never admit their faults. Never ever going there again. If wish to use this firm keep a diary or always have someone with you when meeting or talking with them.

Reasons/basis



Summary of Facts

2.1 The firm entered into an arrangement with the National Centre for Domestic Violence

( "NCDV" ) for the referral of clients seeking urgent legal assistance.

2.2 The NCDV carried out preparatory work on the cases, such as obtaining the

client's witness statement, before referring the client to the firm. The firm paid NCDV

?170 plus VAT for each referral. The cases referred by NCDV all benefitted from

public funding.

2.3 The firm did not tell the clients referred to them by NCDV that the firm had paid a fee

for that referral.

Admissions

3.1 The firm makes the following admissions which the SRA accepts:



3.1.1 that by making payments to an introducer in respect of clients who have the

benefit of public funding, it failed to achieve Outcome 9.6 of the SRA

Code of Conduct 2011.

3.1.2 that by failing to inform clients of any financial or other interest which an

introducer had in referring the client to the firm, it failed to achieve Outcome

9.4 of the SRA Code of Conduct 2011.



Why the agreed outcome is appropriate

4.1 In relation to the admissions above, the SRA considers that the agreed outcome is appropriate as the conditions in rule 3.1 of the SRA Disciplinary Rules 2011 are met, in that:



4.1.1 the conduct was related to a failure to comply with the firm's

regulatory obligations;

4.1.2 the agreed outcome is a proportionate outcome in the public interest

4.1.3 the conduct was neither trivial nor justifiably inadvertent.



4.2 In deciding that the agreed outcome is proportionate, the SRA has taken into account the following mitigation which the firm has put forward:



4.2.1 it has stopped paying referral fees to NCDV;

4.2.2 it has complied with the SRA's investigation, made admissions and apologised for it's conduct;

4.2.3 it has reviewed its procedures and made changes to reduce the risk of similar breaches occurring again.



4.3 The amount of the fine takes account all relevant circumstances, including those set out in Appendix 1 to the SRA Disciplinary Procedure Rules 2011.

4.4 The SRA considers it appropriate that this Agreement is published in the interests of transparency in the regulatory and disciplinary process.

Acting in a way which is inconsistent with this Agreement

5.1 The firm agrees that it will not act in any way which is inconsistent with this agreement such as, for example, by denying the admissions above.

5.2 If the firm acts in a way which is inconsistent with this Agreement, the conduct which is subject to this agreement may be subject to further consideration by the SRA . That may result in a disciplinary sanction or a referral to the Solicitors Disciplinary Tribunal on the original facts and allegations. Acting in a way which is inconsistent with this agreement may also constitute a separate breach of Principles 2, 6 and 7 of the SRA Principles 2011.

Costs

6.1 The firm agrees to pay the costs of the SRA's investigation in the sum of ?1350. Such costs are due within 28 days of a statement of costs due being issued by the SRA.

Had a appointment with Jaswinder Kasli she arrived 45 minutes late and only seen me for 15 minutes took my money and then said I will probably deal with your case - was very quick to take the money, my appointment was for an hour and I came from far as I just moved in the area. She said I have no availability for 3 weeks what a waste of time and money will not recommend at all - She is a Timewaster with an altitude.

Exceptionally poor service. The lawyers dont even know the law properly. Got me to lodge the wrong application. When you try contacting them never pick up the phone or respond to emails until you threaten to lodge an official complaint. Generally reluctant to give anything in writing. Missed appointments with no apologies. Conned me out of about 3k so far.

I cannot state clearly enough how much the discerning client should avoid this dog-and-pony show of a law firm. As we all can see from previous corporate responses to complaints, Duncan Lewis seems to pride itself on general satisfaction. That may be the case, but at the Harrow branch you will NOT be happy with the service.
I am a survivor of domestic violence with a domestic violence settlement having been granted by HRMC (with a different and very competent solicitor) 6 months before the divorce case was heard because of DL's incompetence in chasing my ex-husbands petition. I was then 'advised' not to ask for any financial settlement despite my legal costs and fees and letters were written to my ex's solicitors to that effect: I had to send 'cease and desist' 11th hour emails and similar phone calls to prevent these emails going through. Ultimately because I needed rid of my domestically violent husband (as deemed by HRMC) I took a quick under £1000 settlement as per DL to 'make things quick'.
This firm will make a painful, difficult divorce much much worse. Avoid.

I had the unfortunate experience of using this firm recently for a family law matter. The employee I dealt with was a trainee solicitor, every letter that was written usually contained inaccuracies, and more often than not I had to re-write them. When it came to filling in forms, the correct boxes had not been ticked and I had to insist that I checked everything before it was sent off.

In a few cases a google search provided more accurate information than the guidance I was given, I googled the details because I didn't believe what I was being told.

I would strongly advise going elsewhere, appalling.

I would strongly advise people never to go to Duncan Lewis. They have employeed just a few trained staff who are only used to produce Cost Estimate letters to the Legal Aid Agency to sip out public funds. All the work on your file is done by caseworkers who prepare poorly drafted letters to court. Duncan Lewis sipped out funds of over £50,000 on my LAA Certificate only to leave me without representation at the last minute before my final hearing. Unrealiable, unprofessional and merciless is their approach. Their own goal is to receive maximum funds out of the LAA Agency. After those funds are received by them their attitude towards you become rude and abusive. They just refuse to do any work on your files and keep making excuses.

I had the misfortune of being transfered to this firm from the Civil Legal Advice team. The person I was connected to was NOT interested in helping me, he was even rude about the person from Civil Legal Advice. He did not want to help me with the law I was trying to rely on, in fact I got the impression that because he was ignorant of that law he was just trying to get rid of me.

If Civil Legal Advice means that you get put through to a lawyer who is rude and abusive, who just wants to tell you to go get a local lawyer then that is a real abuse of the legal aid system.

In the past I have called the Civil Legal Advice team and been transferred to someone from Shelter's Legal Team, they spend over an hour speaking with me on the phone and called me back with a follow up.

So that is why I KNOW that Duncan Lewis provided a shoddy service, provided by someone who really has no interest in helping me, who was rude and abusive.

Far from the promised service that says

"Whilst we consider ourselves expert in the matters we undertake we never forget that we are dealing with people, frequently disadvantaged, who may find the law complex and daunting. We undertake to guide you through the law by applying it to resolve the problems that you entrust to us."

Well that was not MY experience.

People like me are in serious need of proper legal advice when facing eviction from our home, it seems to me that Duncan Lewis are just a machine, they put in these Housing Caseworkers that nobody else would employ and just grab the legal aid fee.

It really concerns me that people like this are giving vulnerable people poor advice and just shovelling them off without offering any practical legal help.

I visited Duncan Lewis earlier this year to handle my divorce. I have two children, both under the age of 10 and I was more worried about how they would feel throughout the process. I visited Duncan Lewis in Hackney and saw Adishetu Momoh Abu. She dealt with all my problems and understood what I am going through. Adishetu took me through all the possible options for our children and we were able to come to an amicable agreement.

I am very thankful for the help and support that Duncan Lewis gave me to push forward and deal with my divorce quickly by keeping me up to date with any updates to my case.
