Reasons/basis

In the matter of Varun Krishnakumar, a person who is or was involved in legal practice but is not a solicitor.

Section 43 Solicitors Act 1974 (as amended)

In 2016, Mr Krishnakumar was working in the IT department for FieldFisher LLP. At a Christmas party, he assaulted a female colleague.

The Central Criminal Court, Old Bailey convicted Mr Krishnakumar of sexual assault on a female - no penetration on 6 July 2016. He was sentenced to twelve months imprisonment. He was ordered to be placed on the Barring List by the Disclosure and Barring Service; pay a victim surcharge of ?100; and register with the police under section 92 of the Sexual Offence Act 2003 for a period of 10 years.

Finding

Varun Krishnakumar was involved in a legal practice (as defined by section 43 (1A) of the Solicitors Act 1974) and has been convicted of a criminal offence which is such that in the opinion of the Society it would be undesirable for him to be involved in a legal practice in any of the ways described in the order below.

Order

To make a section 43 order with immediate effect that:



(i) no solicitor shall employ or remunerate him in connection with his/her practice as a solicitor;

(ii) no employee of a solicitor shall employ or remunerate him in connection with the solicitor's practice;

(iii) no recognised body shall employ or remunerate him;

(iv) no manager or employee of a recognised body shall employ or remunerate him in connection with the business of that body;

(v) no recognised body or manager or employee of such a body shall permit him to be a manager of the body; and

(vi) no recognised body or manager or employee of such a body shall permit him to have an interest in the body



except in accordance with a Society permission.
