Decision details
Ms Kitchen was employed by Freeths LLP as a senior legal cashier.

Following concerns raised by the firm's accounts team, an investigation revealed that Ms Kitchen had taken ?4,437.36 of client money over a 12 month period

At an internal disciplinary hearing, Ms Kitchen admitted to taking the money and in mitigation, referred to her financial and mental health issues.The firm dismissed her.

The Adjudicator made a finding of dishonesty against Ms Kitchen and she was made subject to an order pursuant to section 43(2) of the Solicitors Act 1974 (as amended). Ms Kitchen was also ordered to pay the SRA's costs of ?800 in investigating this matter.

With effect from the date of the letter notifying Ms Kitchen of the decision, being 09 November 2018:

no solicitor shall employ or remunerate her in connection with his/her practice as a solicitor;
no employee of a solicitor shall employ or remunerate her in connection with the solicitor's practice;
no recognised body shall employ or remunerate her;
no manager or employee of a recognised body shall employ or remunerate her in connection with the business of that body;
no recognised body or manager or employee of such a body shall permit her to be a manager of the body; and
no recognised body or manager or employee of such a body shall permit her to have an interest in the body
except in accordance with a Society permission.

Reasons/basis
Ms Kitchen has occasioned or been a party to an act or default in relation to a legal practcie which involved conduct on her part of such a nature that it would be undesirable for her to be involved in legal practice in any of the ways set out in the s43 Order.
