An Adjudicator DECIDED to GRANT Mr Abiodun Oludare Odunlami a practising certificate for the practice year 2010/2011 pursuant to Section 16(4) of the Solicitors Act 1974 (as amended by the Legal Services Act 2007 (in force 31 March 2009)) and Regulation 3.2(b)(iii) of the SRA Practising Regulations 2009 subject to the following conditions:-

1. He may act as a solicitor only in employment, the arrangements for which have first been approved by the Solicitors Regulation Authority.
2. He is not a sole practitioner or a manager or owner of a recognised body.
3. That Mr Odunlami fully informs any actual or prospective employer of these conditions and the reasons for their imposition.

Outcome details

This outcome was reached by SRA decision.
Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include :-

• He failed to deliver an Accountant’s Report for the period ending 31 May 2009 promptly or at all.

• He failed to comply with an Order of an SRA Adjudicator and in so doing acted in a manner likely to diminish the public confidence in the profession.

• He failed to act with the SRA in an open, prompt and cooperative manner.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Reasons/basis

1. The Panel was satisfied that grounds for intervention existed under Paragraph 1(1)(a) of Part I of Schedule 1 Solicitors Act 1974 (as amended). The Panel was satisfied that there was reason to suspect dishonesty on the part of Abiodun Oludare Odunlami.

2. The Panel was satisfied that grounds for intervention existed under Paragraph 1(1)(k) of Part I of Schedule 1 Solicitors Act 1974 (as amended) namely that Abiodun Oludare Odunlami has acted as a solicitor at a time when he did not have a practising certificate which was in force.

3. The Panel was also satisfied that grounds for intervention existed under Paragraph 1(1)(l) of Part I of Schedule 1 Solicitors Act 1974 (as amended) namely that Abiodun Oludare Odunlami failed to comply with a condition imposed on his practising certificate for 2007/2008 that he may act as a solicitor only in approved employment or approved partnership. Mr Odunlami has continued to practise as sole principal of Anthony Taylors Solicitor since the condition came into effect on 9 December 2008.

4. The Panel was also satisfied that grounds for intervention existed under Paragraph 1(1)(m) of Part I of Schedule 1 of the Solicitors Act 1974 (as amended), namely, that the Panel was satisfied that it was necessary to exercise the powers conferred by Part II of this Schedule (or any of them) in relation to Abiodun Oludare Odunlami to protect the interests of clients (or former or potential clients) of Mr Odunlami or his firm, or the interests of the beneficiaries of any trust which Mr Odunlami is or was a trustee.
