Compiled from data from the Solicitors Regulation Authority website

      08/01/10

      Wolstenholmes of Cheadle and Birmingham
      8 January 2010

The firm has been intervened into (in other words, closed down) by the Solicitors Regulation Authority (SRA).

The intervention protects the immediate position and safeguards documents and clients' money. The SRA has appointed a law firm which has collected clients' files and is keeping them safe.

The law firm is DWF solicitors and the person responsible there is Kieran Walshe.

      DWF solicitors is at
      Centurion House,
      129 Deansgate,
      Manchester,
      Lancashire,
      M3 3AA

      Tel: 0161 603 5000
      Fax: 0161 603 5050

The SRA has also enlisted the help of Gordons LLP of 14 Piccadilly, Bradford, West Yorkshire, BD1 3LX to assist Kieran Walsh of DWF solicitors. Unless you are contacted directly by Gordons LLP, your point of contact should be DWF solicitors.

We can, in effect, close a practice. We call this an "intervention". An intervention has the effect of ending the practice.

An intervention is a step taken to protect clients' interests and money. It is a protective measure, and does not necessarily mean we have made any findings against a regulated person or firm. A prosecution before the Solicitors Disciplinary Tribunal is likely to follow.
      Effects of an intervention

      * We take possession of the practice documents, including client papers.
      * The legal right of the practice to hold and distribute money is given to us.

      When do we intervene?

Legislation gives us a range of reasons for intervention. These are known as "grounds".

      We can intervene if

      * there are grounds to intervene, and
      * an intervention is needed to protect the public.

A regulated person or firm can appeal to the High Court against our decision to close their practice.
      Reasons for an intervention

Legislation gives us a range of reasons for closing a practice. These are known as "grounds" for intervention. An example is when we have reason to suspect dishonesty by a regulated person.
Other examples of grounds for intervention

      * A recognised sole practitioner has been adjudged bankrupt.
      * A recognised sole practitioner has been committed to prison.
      * There has been a serious breach of the Accounts Rules.
      * The firm has been abandoned.

More information about grounds for intervention

      * Solicitors' practices – section 35 and Schedule 1 of the Solicitors Act 1974 (as amended)
      * Registered European lawyers – section 35 and Schedule 1 of the Solicitors Act as applied by the European Communities (Lawyers Practice) Regulations 2000 (ECR 2000)
      * Registered Foreign lawyers – Schedule 1 of the Solicitors Act 1974 as applied by paragraph 5 of Part II of Schedule 14 of the Courts and Legal Services Act [1990])
      * Recognised bodies – Schedule 1 of the Solicitors Act 1974 as applied by paragraphs 32-35 of Schedule 2 of the Administration of Justice Act [1985])

Appalling - do not use these people for conveyancing. I had several different conveyancers assigned to my purchase without being informed of the change. It was also impossible to obtain any information from them as to progress with the purchase. I eventually gave up and transferred to another solicitor rather than loose the sale

Wolstenholmes are a waste of time. I mean they are cheaper than some Solicitors, and on paper it should work like a breeze, but in reality its like pulling teeth. You always go through to an answer phone, its takes days for them to get back to you and the communication is simply not good enough. What should be a simple process of conveyancing has turned into an embarrassing mess. My estate agent, my purchasers solicitors and the property developers of our new house all think that they are a total and utter joke. I have now had 3 different solicitors manage my case, as the others apparently have all left? Brilliant! A word to the wise, stay away from these clowns, spend a little more and get a better service as if moving house ain't stressful enough you gotta keep chasing unprofessional wasters like these!...
